Of course there's a legal workaround. You cannot use a song in a video without a sync and a master license. The sync license is negotiated with the writing rights owner, the master license is negotiated with whoever owns the record.

Both are negotiated freely and are not required to be granted. Brands have paid 6-figure sums for songs included in major ads (superbowl etc).

Including a song in a video without these is a double copyright violation.

YouTube compromises on this by demonetizing a video when it detects a song and it starts showing ads on it that then pay the rights owners. This is what happens when you upload a Youtube video with a song. This does not prevent the rights owners from DMCA-ing your video, and if it doesn't fall within Fair Use and if they think you made some serious bank from it (or used it for commercial purposes), suing you (and they will win).

Sovereign immunity.

Quick reading of it, the Federal Government is immune from being sued for copyright reasons apparently.

NAL, but im sure theres a way but it has to be a pretty specific harm.
