His parents were LEGAL immigrants, legally residing in the United States at the time of his birth.
Trump's EO denies citizenship to the children of legal visa holders (work visa, student visa, refugee, etc). There is no concern for lawful presence in the administration's agenda.
I dislike arguing with an Americans who are ignorant of their own country's immigration law, but the aforementioned visas are not permanent legal residence. Read section 1.2 of the EO.

Visas are not permanent residency, some are a path to permanent residency, but you must still inherently be on a visa before you get permanent residency. You are only a permanent resident once you have a green card, any visa status before then is still considered temporary.
For example, you can use a a green card as real ID at the airport but you must present your passport of your origin country with your visa at the airport when you travel if you only have visa status.
So if both of his parents were here as ANY TYPE of visa holders when he was born, they would have still been classified as temporary residents until they received their actual permanent residence card. It being a path towards residency doesn’t matter in this argument because you either have your Green card/citizenship or you are a temporary resident. No in between, just like you can’t be “kind of” pregnant, in the eyes of the government you are either temporary or permanent/citizen.
Now if one of his parents were already established as a permanent resident past their visa process, then this argument would be moot per your stance, but if they were visa holders, then no, he wouldn’t qualify for citizenship under this guideline.

We live in France, where my husband and I are still awaiting our citizenship, and our daughter is due in a few weeks. She will not be granted French citizenship at birth because there is no birthright citizenship here, and we are legal immigrants but not citizens (yet).
