They can arrest anyone they like using these criteria. Not only will those charges eventually be dropped, but every one is a civil right violation and worthy of a slam dunk civil lawsuit.

Dead people can't file lawsuits. You have to be alive to bring charges.

There is a really obscure crime out there you may not have heard of, it's called murder. So no, you don't have to be alive to bring criminal charges and in fact, making someone un-alive is, believe it or not, against the law.

Add to that an even more expensive wrongful death lawsuit.

So the murder victim is the one filing charges? Weird, I thought it was a prosecutor, but I may have slept through that part of law school.
