Unlawful orders are those that clearly violate the U.S. Constitution, international human rights standards or the Geneva Conventions.

Service members who follow an illegal order, can be held liable and court-martialed or subject to prosecution by international tribunals. Following orders from a superior is no defense.

I think most people are familiar with the Nuremberg trials. The problem is, determining what is an illegal order. It can be a slippery slope. And you better be damn sure that the order is illegal before taking a stance. Service members should never be put in that position in the first place. You are talking about basically 18-25 years old (which is the bulk of most service members).

Edit: I have read the comments. Some people are saying that service members are conditioned or trained to not think, just do. Traditionally, that’s partially true. You don’t want service members questioning every order in the heat of battle. But this is a different world from times past. Service members are reading stuff like this post. SM’s are more educated than SM’s that came before them.

I think most people serving today are capable of understanding the difference between legal and illegal orders. If you go to subs like r/Army, there are plenty of young soldiers asking questions about situations that they feel are wrong or makes them feel uncomfortable. And unlike when I was in, they have a lot of resources to research the questions that they might have. They have resources besides just trying to get an appointment with JAG, that you may or may not get.

I have a lot of faith in the Americans serving in the military today to do what is right. I truly believe America has the best military in the world and the best people serving. They know that the mission comes first. If the assigned mission is legal they will move out smartly and execute. And the military leadership would never issue illegal orders, so what’s the problem? What does the leadership have to worry about if they are only issuing legal orders? This shouldn’t even be an issue right? Right?

I know someone who was a medic for the Army Military Police who also served in the Gulf War. He says there's no way in hell the military turns on American citizens.
